On 25 January 2018, the Board of Appeal in Public Service Cases ruled in an appeal case that was filed by a former customs officer in Curaçao. The public servant in question was honorably dismissed by national decree as of 1 March 2015, because of functional unsuitability for the position that she held.
Reasons for the dismissal included frequent unauthorized absence, an attempt at fraud and deceitful behavior. The public servant in question objected to her dismissal, which objection was declared unfounded by the Court of First Instance. The public servant then appealed the judgment. The defendant, the government of Curaçao, was successfully represented in this appeal case by attorney at law Sophie van Lint.
According to the Board of Appeal in Public Service Cases, the government of Curaçao made sufficiently plausible that the dismissal on grounds of unsuitability was justified. In the appeal proceedings, the public servant’s objections against her dismissal were therefore once more rejected. The Board of Appeal in Public Service Cases upheld the earlier judgment of the Court of First Instance.
