As reported widely in the regional Dutch Caribbean media, various summary proceedings took place yesterday (Thursday 15 September) in light of the protests and strikes organized by the various labor unions in Curaçao. On behalf of VANEPS, Kimberley de l’Isle and Mayesi Hammoud represented union SGTK in two different summary proceedings.
Counsel Kimberley de l’Isle assisted SGTK in the summary proceedings against 11 united contractors: the AAV. The matter was initiated by AAV to force the employees that are based on the Isla site, to resume their work. Kimberley de l’Isle argued on behalf of the union that the strike was an acceptable and necessary instrument to convince AAV to meet SGTK’s demands. The court agreed; the strike was not considered illegitimate, and as a result the AAV was ordered to pay the costs for the legal proceedings.
Partner Mayesi Hammoud assisted SGTK in a summary proceedings session that took place adjacently, which was about the legality of the ministerial decree regarding the ban on assembly. Although this decree is now revoked by minister Navarro, the court was still asked to rule in this matter in relation to the costs of the legal proceedings. The judgment is expected within days.
